Experience South West Tours - ExpSW
​Bookings 
ExpSW only accepts bookings from persons over  18yrs of age.
ExpSW will confirm all bookings via email and you will receive a deposit or full payment request 3-4 days later.
The Contract between ExpSW and the customer will then come to effect, binding  both parties from the date that we receive the deposit or payment.

If you have a disability, suffer from any allergy or have any relevant medical condition that may impact your tour, please inform ExpSW at the time of booking. We will try to accommodate as best we can. 

​Cancellation by customer 
All cancellation notifications must be sent by email to [email protected] in good time
For all cancellations, subsequent fees shall apply against the full booking price. 
Cancellation in more than 28 days prior to the tour date - 30% of total booking costs with held. 
Cancellation in less than 28 days prior to the tour date - ​100% of total booking costs with held.
If booked through hotel partner & then cancelled under 48hrs of tour due date/time, cancellation charges of 100% booking fees apply. 
Agreed at point of booking and initial payment secured.

Cancellation by ExpSW 
In unforeseen circumstances that could not be prevented, ExpSW reserves the right to cancel a tour at any time. In this event we will refund booking costs in full to the customer. 
In the event of any cancellation, ExpSW will not accept liability for any consequential expenses that the customer may incur as a result, or for any other loss or damage caused arising out of the cancellation. The customer should have suitable insurance cover in place for such events, should they arise. 

Amendments to booking 
Once your booking has been confirmed, any subsequent amendment requests must be submitted by the customer/client in writing, via email, at earliest point to allow for itinerary changes. ExpSW will try to accommodate any such amendment requests asap. Approved amendments will be confirmed by ExpSW along with any price revisions (if applicable where itinerary is prolonged or third party supplier activity is added at later date)

Payments

Deposits - Min 25% Within 7 days of the confirmed booking 
Final balance payment - Up to 75%
No less than 28 days before tour date. 
All transfers of funds to ExpSW are to be made net of any other charges 
Payment methods made by BACS bank transfer. Details provided at point of booking.
Cash payments can be made on the tour date, however deposits ideally required as above at booking.
Once invoiced payment terms of invoice settlement within 28 days of tour delivery apply as stated on invoice and agreed at point of booking.
If payments are not received by the required date ExpSW will communicate with the customer in an attempt to resolve and proceed with booking/further bookings. ExpSW reserves the right to cancel the contract if payments are not made by the required dates. Cancellation policies set out in these terms will then apply. 

Hotels
Where referred by partner hotels the arranged and agreed referral fees will apply and be paid at point of booking, invoice settlement or as agreed with particular hotel as per Tour price structure referring to numbers, tour destination and/or logistics of the booking.

​Weather and other Circumstances 
Logistics and circumstance beyond our control require an element of flexibility to allow for changes to itinerary, either for safety reasons or customer requirement. Suitable clothing, footwear and any walking aids required should be provided by the customer unless requested at point of booking and if can be sourced by ExpSW. The SW is a peninsula that is surrounded by water and subsequently the weather is changeable. Tour itineraries may require last minute changes to maximise guests experience and safety in the event of sever or adverse weather conditions. 

​On Tour
Whilst on tours, clients/guests must adhere to advice of guide at locations whereby risk is pre-identified and pointed out to them. Site safety rules, hazard perception and following such advice is key to guest safety at all times.
The customer acknowledges that there are elements of personal risk in participating in one of our tours and accepts the liability ExpSW has set out here as a notification of this risk.
Access issues at familiar, known locations, whereby access could be difficult, will be discussed at booking to maximise guests experience. Client/customer honesty in their mobility at point of booking is paramount to allow for accommodating any access difficulties.

​Third Party Activities
All additionally booked third party activities, Heritage houses and sites as well as attractions we attend on tours are governed by their own independent  policies, regulations and liability insurances, ExpSW accepts no liability at these locations once under their cover. ExpSW accepts no liability for incident or accident whilst participating and engaging in said third party booked activity. Payment terms of the third party apply at either point of inquiry and booking or will be added to invoices at itinerary build point if ExpSW orchestrates payment upfront.

English Binding / Governing Law 
The contract is construed in conjunction with English law and customers submit to the exclusive jurisdiction of the English Courts to settle any disputes which may arise out of, or in connection with contracts or incidents.
